TERMS AND CONDITIONS

Introduction. Effective 1 May 2021, these terms and conditions (hereinafter, "Agreement") set out between the buyer (hereinafter, "Buyer", "you") and Zutara OPM (hereinafter, "we", "our") shall govern the purchase, distribution, and use of our digital fan-made Golden verse merch (hereinafter, "Product", "Products").

Disclaimer. The Products are not official and are fan-made, including the alternative universe, “Goldenverse'' on which they are based. Characters are from Avatar: The Last Airbender which was created by Michael Dante DiMartino and Bryan Konietzko for Nickelodeon.

“Products” refers to the digital merch based on the fan-made social media AU, “Golden” centered on the pairing of Zuko and Katara. “Products” include: (1) Goldenverse map, (2) Augmented Reality (AR) art, and (3) printable stickers.

Terms of Use. Your purchase of the Products grants you a non-exclusive, non-sublicensable, non-transferable permission to download and access the same for the sole purpose of your own personal use and enjoyment. Such use and enjoyment are subject to the prohibitions listed in the succeeding section.

Prohibitions. The following actions are prohibited:

• Copying, re-selling, sublicensing, renting out, sharing or otherwise distributing our Products or any part thereof, whether modified or not, to any third party;

• Using any of our Products in a way which might be detrimental to us and the reputation of our product collaborators;
• Claiming to have created the Product or some items therein; and

• Using the Products in an unlawful way or for any illegal or unlawful purpose(s).

Payment. Purchase of the Product is on prepaid terms. Further, we reserve the right to alter our product prices from time to time. However, no additional charges will be made on your account once you have paid the amount stipulated at the time of purchase.

To secure your online safety, payments shall be made only through Gumroad's payment channels. Any announcement to the contrary, unless made through our official platforms, is deemed invalid. Further, we are not liable for any claims, demands, expenses, actions, costs, damages, or loss that may arise out of payments made through unauthorized and unaffiliated websites.

Distribution. The Product shall be distributed only via Gumroad. A Gumroad download link will be sent to your registered email address once the same is ready for distribution on the same date as Goldenzine TUI / LA.

Cancellation Policy. Once the Product has been purchased by you, such purchase may no longer be cancelled. Any payment made for our Product is final and may not be charged back.

Return/Refund Policy. Due to the non-returnable nature of digital products once they're downloaded, refunds are not allowed.

Non-liability. We are not liable for any claims, demands, expenses, actions, costs, damages, or loss that may result from the use of third party applications to access or activate the Product or some items therein. Claims from such third party applications are governed by their respective distributors' own terms and conditions.

Severability. If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

Applicable Law. This Agreement will be governed, construed, and enforced in accordance with the laws of the Republic of the Philippines.
